1. ABOUT US

Throughout these Terms, “we”, “us” and “our” refer to this seller.

Our store uses Shopify to provide its e-commerce platform. Products purchased through this store are sold by us.

2. SCOPE OF THESE TERMS

These Terms govern purchases from our store and the lawful use of our website.

Our Returns & Refunds Policy and any delivery conditions presented before purchase also apply to your order. Our Privacy Policy separately explains how personal information is processed.

You will have the opportunity to review the applicable terms before placing an order. You may save or print them for your records.

Nothing in these Terms excludes or restricts mandatory consumer rights. Where applicable law gives you more favourable rights, those rights prevail.

3. ELIGIBILITY AND ACCOUNT INFORMATION

To place an order, you must have the legal capacity to enter into the transaction under applicable law. If parental or guardian authorisation is required, you must obtain it.

You must provide accurate and complete information needed to process your order, including your contact details and delivery address. You must be authorised to use the selected payment method.

If you create an account, keep your login details secure and inform us if you suspect unauthorised access.

You are responsible for activity you authorise. This does not make you automatically responsible for unauthorised activity or security failures attributable to us or our service providers.

4. PRODUCT INFORMATION

We aim to describe our products accurately, including their main characteristics, dimensions, materials, functions and included accessories.

Screen settings and lighting may affect how colours appear. This does not excuse a material difference between the product supplied and its description.

Decorative backgrounds, props or other items shown in photographs are included only where the product description says they are.

Products must meet the descriptions and binding representations applicable when you purchase them. Later changes to a product listing do not change an existing order without your agreement.

Please follow the instructions and safety warnings supplied with your product. Contact us if instructions are missing or unclear, or if you believe a product may be unsafe.

5. PLACING AN ORDER

To place an order, select your products, review your basket, enter the required delivery and payment details, and submit your order through checkout.

Before submission, review the quantities, delivery address, total price and delivery information. You can correct details using the available checkout controls.

Submitting an order creates an obligation to pay if we accept it. We will send an email acknowledging receipt.

A contract is formed when we expressly confirm acceptance of your order or dispatch the goods, whichever happens first. An email that only acknowledges receipt is not acceptance unless it expressly states otherwise.

If you do not receive an acknowledgement or notice an error, contact us promptly.

We may decline an order before acceptance for an objective reason, such as unavailable stock, inability to deliver to the selected destination, failed payment, a legal restriction or reasonable evidence of fraud.

If we decline an order after taking payment, we will notify you and promptly refund the amount collected.

Once an order is accepted, we will not change the product, increase its price or cancel it merely at our discretion. Any subsequent change or cancellation must have a lawful basis or your agreement, without affecting your remedies.

6. PRICES, TAXES AND PAYMENT

The currency and price payable are shown during checkout.

We display prices inclusive of taxes where required by applicable law. Delivery charges and any other charges payable to us will be disclosed before you submit your order.

We will not add optional paid services without your express agreement.

Where an international shipment may attract import duties, taxes or clearance charges not collected by us, we will disclose this before purchase, including the amount where reasonably calculable. We will not use these Terms to impose undisclosed charges or transfer taxes that we are legally responsible for paying.

Prices may change for future purchases. Price changes do not affect accepted orders.

Discounts apply according to the conditions disclosed with the offer. A promotion cannot remove mandatory consumer rights.

Payment methods available for your purchase are displayed at checkout. Your bank or payment provider may apply its own currency conversion or transaction charges under its agreement with you.

7. PROCESSING AND DELIVERY

Available destinations, delivery options, charges and applicable delivery estimates will be presented before purchase.

Our current indicative times are:

Great Britain:
Order processing: 2–4 business days.
Transit after dispatch: 6–10 business days.
Indicative combined time: 8–14 business days.

United States:
Order processing: 2–4 business days.
Transit after dispatch: 6–12 business days.
Indicative combined time: 8–16 business days.

Business days generally exclude weekends and public holidays affecting processing or transport.

These estimates are not a promise of delivery by a particular event or holiday unless we expressly agree to that deadline. They do not permit indefinite delays or remove statutory delivery remedies.

For other destinations, use the delivery information supplied for that destination before purchase. The estimates above do not automatically apply worldwide.

We will inform you of material delays we become aware of and explain the available options. Where the law requires your agreement to a revised dispatch or delivery date, we will seek it.

If we fail to deliver within the agreed time, your rights to require delivery, set an additional reasonable deadline where appropriate, cancel or receive a refund remain unaffected.

Where applicable law provides a default delivery deadline in the absence of an agreed period, that deadline applies.

We remain your point of contact for delivery problems, including problems involving a carrier or fulfilment provider.

8. DELIVERY ADDRESS AND RISK

Please check your delivery address carefully and contact us promptly if it needs correction. We cannot guarantee that an address can be changed after dispatch.

If an address error attributable to you results in a failed delivery, we will discuss the available options and disclose any reasonable additional redelivery cost before you agree to it. We will not automatically retain your entire payment.

Risk of loss or damage remains with us until you, or a person you nominate other than the carrier, physically receive the goods.

An exception may apply where you independently commission a carrier that we did not offer, but only to the extent permitted by applicable law.

A carrier tracking status does not prevent you from reporting that you did not receive the parcel. We will investigate disputed deliveries.

9. CANCELLATIONS, RETURNS AND REFUNDS

Our Returns & Refunds Policy explains how to contact us, arrange a return and receive any applicable refund.

We offer a voluntary return period of 90 calendar days from receipt for unused products in their original condition and original product packaging, with all supplied components and accessories.

This voluntary option is not a 90-day product trial and does not limit legal guarantees.

For voluntary change-of-mind returns, the customer pays direct return costs where this responsibility was properly disclosed before purchase and is permitted by law. Original delivery charges are not refunded under this voluntary option unless legally required.

The unused-product and original-packaging requirements do not restrict statutory cancellation rights or remedies for faulty, damaged, incorrect or misdescribed goods.

For eligible purchases covered by EU or UK cancellation law, a statutory 14-day cancellation period generally applies. Its conditions and refund arrangements are explained in our Returns & Refunds Policy.

Contact us promptly if you wish to cancel before dispatch. Dispatch does not remove any statutory right to cancel.

Nothing in these Terms overrides a more favourable binding promise made to you before purchase.

10. FAULTY GOODS AND LEGAL GUARANTEES

If goods are faulty, unsafe, damaged on arrival, incorrect or materially different from their description, contact us at spectra.mummy@use.startmail.com.

We will assess the issue and provide the repair, replacement, price reduction, refund or other remedy required by applicable law.

We may request reasonable proof of purchase and information needed to assess the issue. An unboxing video is not compulsory.

Legal remedies are not automatically excluded because a product has been used, its original packaging is missing or more than 90 days have passed.

We will bear or reimburse return, transport and other remedy-related costs where required by law.

Applicable legal guarantees, including Spanish conformity rights, UK consumer rights, Australian consumer guarantees and mandatory rights in other markets, remain unaffected.

11. WEBSITE AVAILABILITY AND THIRD-PARTY SERVICES

We take reasonable steps to maintain our website, but access may occasionally be interrupted by maintenance, technical problems or events outside our reasonable control.

An interruption does not remove our obligations relating to accepted orders, refunds, data protection or consumer rights.

Our website may use payment providers, delivery services or other third-party functionality. Separate terms may apply to services you contract for directly with those providers.

We remain responsible for obligations that the law places on us. We do not exclude responsibility merely because we use a third-party provider to fulfil an obligation.

External links are provided for convenience. A link does not, by itself, constitute an endorsement of an external website.

12. RELATIONSHIP WITH SHOPIFY

Shopify provides the e-commerce technology used by our store. The sales contract for products purchased from Spectra - Crawling Mummy is between you and Monir Ibn Lafqih Makowska.

Please direct questions about your order, delivery, returns and product problems to us.

Shopify may separately provide services governed by its own applicable terms and privacy information.

This section does not require you to waive any claim against Shopify or another party where such a waiver would be unlawful, and it does not limit our responsibilities as the seller.

13. PRIVACY

Our Privacy Policy explains how we collect, use, retain and share personal information, including information processed through Shopify and other service providers.

Using the website or accepting these Terms does not, by itself, constitute consent to optional marketing, non-essential cookies or processing that requires separate consent.

Where consent is required, it will be requested separately. Your statutory data protection rights remain unaffected.

14. INTELLECTUAL PROPERTY

Website content may be protected by copyright, trade mark or other intellectual property rights belonging to us or the relevant rights holders.

You may browse the website and save or print information reasonably necessary for your personal shopping, record keeping or exercise of legal rights.

You must not unlawfully reproduce, sell, redistribute or commercially exploit protected content.

Nothing in these Terms restricts uses permitted by law, including applicable quotation, review or other intellectual property exceptions.

Third-party names and marks belong to their respective owners. Their appearance on this website does not imply an affiliation unless expressly stated.

15. CUSTOMER REVIEWS AND SUBMISSIONS

Reviews should reflect genuine experiences and must not knowingly contain false statements, unlawful content or material that infringes another person's rights.

If a review was incentivised, that fact should be disclosed.

You retain ownership of content you submit. For reviews submitted for publication, you grant us a non-exclusive permission to display them and make technical formatting changes necessary to publish them in connection with the relevant product or store.

We will not alter a review to misrepresent its meaning or remove it solely because it expresses a negative opinion.

We may remove spam, unlawful content, personal information published without permission or content unrelated to a genuine customer experience.

Private customer-service correspondence is not automatically licensed for public advertising. Any additional use requiring permission will be addressed separately.

16. ACCEPTABLE USE

You must not use the website to:

- Commit fraud or impersonate another person.
- Submit payment details you are not authorised to use.
- Upload malicious software.
- Attempt unauthorised access to accounts or systems.
- Unlawfully collect or misuse personal information.
- Infringe intellectual property rights.
- Send threats, unlawful harassment or spam.
- Deliberately disrupt the website or bypass security controls.

Legitimate complaints, honest reviews and the exercise of consumer rights do not breach these Terms.

Automated tools must not bypass security measures, misrepresent their authority, place unauthorised orders or impose an unreasonable load on the website.

We may proportionately restrict access where reasonably necessary to address fraud, security threats or a material breach. Where appropriate, we will explain the restriction and provide a contact route to question it.

Restrictions on website access do not cancel valid refund claims, legal guarantees or our obligations under existing orders.

17. ERRORS AND CORRECTIONS

If we identify an error in a listing, price or delivery information, we will correct it promptly.

If an error affects your order, we will contact you and explain the available options. We will not substitute a different product or charge a higher price without your agreement.

The treatment of an error in an already accepted order will follow applicable law. A website error does not give us an unrestricted right to cancel a binding contract.

18. LIABILITY

We are responsible for breaches of our contractual and legal obligations in accordance with applicable law.

We do not exclude or limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

We do not exclude mandatory product safety obligations, consumer guarantees or compensation rights.

You are not required to indemnify us, Shopify or our providers merely because you browse the website, purchase a product, make a complaint or exercise a legal right.

Any claim arising from unlawful conduct by either party will be assessed under the applicable legal rules, including causation, evidence and recoverable loss.

19. EVENTS OUTSIDE OUR REASONABLE CONTROL

If an event outside our reasonable control affects an order, we will take reasonable steps to reduce its impact and inform you of material consequences.

Such an event does not automatically transfer delivery risk to you, permit us to retain payment without supplying goods, or remove any applicable cancellation or refund rights.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by Spanish law.

This choice does not deprive a consumer of mandatory protections that apply under the law of their country of habitual residence or any other applicable mandatory law.

Any dispute may be brought before the courts competent under applicable law. Nothing in these Terms requires you to use Spanish courts exclusively or removes a right to bring proceedings in your home jurisdiction where the law provides that right.

We do not impose compulsory private arbitration or a waiver of collective remedies.

Please first contact spectra.mummy@use.startmail.com if you wish to raise a complaint so we can attempt to resolve it. This is not a prerequisite that prevents you from approaching a competent consumer authority or court.

We will acknowledge complaints and respond without undue delay within any applicable legal deadline. Where required, we will provide information about relevant alternative dispute-resolution arrangements and whether we are obliged or willing to participate.

21. CHANGES TO THESE TERMS

We may update these Terms for future transactions and website use.

The version applicable when your order is concluded continues to govern that order unless a change is legally required or expressly agreed with you.

Posting an updated version does not retrospectively reduce your rights under an existing order.

Where notification or express agreement is legally required, we will provide or obtain it.

22. GENERAL PROVISIONS

If a provision is unlawful or unenforceable, it will not bind you to that extent. The remaining provisions will continue to apply where legally possible.

We will not replace an unfair provision with another that has the same prohibited effect.

A delay in exercising a right does not automatically waive that right.

These Terms do not exclude binding pre-contract information, product descriptions, advertisements or promises that form part of your purchase under applicable law.

Any transfer of our contractual obligations must comply with the law and must not reduce your guarantees or remedies. We will notify you where required.

Mandatory rules on interpreting consumer contracts remain applicable.
